1. Eligibility

PhotoPulse.pro™ provides photography-related tools, content, software, analytics, image management features, AI-powered services, educational resources, and related products or services. Features may change, be added, suspended, or discontinued at any time.

3. Account Registration

Certain features may require you to create an account. You agree to:

• Provide accurate and complete information;
• Maintain the security of your account credentials;
• Promptly update account information when necessary; and
• Accept responsibility for all activities occurring under your account.

You must notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of photographs, images, text, metadata, and other materials you upload, submit, or create through the Service (“User Content”).

By submitting User Content, you grant PhotoPulse.pro™ a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, display, and distribute such content solely as necessary to operate, improve, and provide the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content;
• Your User Content does not infringe third-party rights;
• Your User Content does not violate applicable laws; and
• You have obtained all necessary permissions from individuals appearing in uploaded images where required.

5. AI-Generated Content

If the Service includes artificial intelligence features:

• AI outputs are generated automatically and may contain inaccuracies;
• You are responsible for reviewing and verifying AI-generated content;
• Similar outputs may be generated for other users; and
• PhotoPulse.pro™ does not guarantee exclusivity of AI-generated content.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes;
• Upload illegal, harmful, defamatory, infringing, or abusive content;
• Reverse engineer, copy, or exploit the Service without authorization;
• Interfere with the security or operation of the Service;
• Use automated systems to scrape or access the Service without permission;
• Upload malware, viruses, or malicious code.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

The Service, including its software, design, logos, trademarks, text, graphics, and content, is owned by PhotoPulse.pro™ or its licensors and is protected by intellectual property laws.

PhotoPulse.pro™, related logos, and branding are trademarks or common-law marks owned by PhotoPulse.pro. Unauthorized use is prohibited.

8. Subscription Plans and Payments

Certain features may require payment. By purchasing a subscription, you agree that:

• Fees are charged as disclosed at purchase;
• Subscription plans may automatically renew unless canceled;
• Taxes may apply where required by law; and
• Fees are generally non-refundable unless required by law or otherwise stated.

We reserve the right to modify pricing with reasonable notice.

9. Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third parties.

Your use of third-party services is governed by their respective terms and policies.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect information.

11. Copyright Complaints

If you believe content on the Service infringes your copyright, please contact us with:

• Your contact information;
• A description of the copyrighted work;
• Identification of the allegedly infringing material; and
• A statement made in good faith that the use is unauthorized.

We may remove allegedly infringing content as required by law.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTOPULSE.PRO™ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not guarantee uninterrupted, secure, or error-free operation.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTOPULSE.PRO™ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

• THE AMOUNT PAID BY YOU TO PHOTOPULSE.PRO™ IN THE PRECEDING TWELVE (12) MONTHS; OR
• ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

14. Indemnification

You agree to indemnify, defend, and hold harmless PhotoPulse.pro™, its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses arising from:

• Your use of the Service;
• Your User Content; or
• Your violation of these Terms.

15. Termination

We may suspend or terminate access to the Service at any time, with or without notice, if you violate these Terms or if necessary to protect the Service or other users.

Upon termination, your right to use the Service immediately ends.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles.

Any disputes shall be resolved in the courts located in Multnomah County, Oregon, unless otherwise required by applicable law.

17. Changes to These Terms

We may modify these Terms at any time. Updated Terms will be posted on the Service with a revised effective date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
